Sen. Ben Nelson (D-Neb.) reached out Thursday evening to South Carolina GOP Attorney General Henry McMaster, the leader of a group of 13 Republican state attorneys general who are threatening to file suit against the Senate health care bill, and urged him to forgo any legal action, POLITICO has learned.

According to a copy of a memo sent by McMaster’s chief of staff to other GOP state attorneys general detailing the call, Nelson asked McMaster to “call off the dogs,” a reference to recent threats by the state AGs to file a lawsuit challenging the constitutionality of a Medicaid provision in the bill that benefits Nebraska at the expense of other states.

Under the terms of a deal Nelson cut with Senate leaders to secure his crucial vote for the health care package, Nebraska would be exempted from having to pay for the coverage of its new Medicaid enrollees—leaving the federal government to pick up the tab. The deal is expected to cost the federal government $100 million over the next 10 years.

Nelson has been under tremendous political pressure since details of the deal emerged and on Tuesday, Rasmussen Reports released the results of an automated poll that showed troubling numbers for Nelson, who is not up for re-election until 2012.

One day later, Nelson aired a television ad explaining his vote.

“With all the distortions about health care reform, I want you to hear directly from me," the Democratic senator said in the ad.
The telephone survey of 500 Nebraskans, conducted Monday, suggested Republican Gov. Dave Heineman would defeat Nelson in a potential 2012 Senate race by a 61-30 margin.
The poll showed Nelson with a 55 percent unfavorable rating and 64 percent disapproval for Democratic health care reform legislation.

Dodd quit, Helmet head Dorgan quit. Harry Reid, Blanche Lincoln, and several others up for reelection next year are polling in the high 30's and low 40's. Several Governors have declined to run again. 12 congressional dems are retiring. Recruitment is in the toilet. 2010 is going to be a very bad year for Democrats.

That's a good point. Its pathetic that so many dems are quitting because they didn't do enough to even keep their base happy. I'd rather see them lose to people in their own party for not doing their job. At this point I think the Republicans will gain a few seats but it all depends on what the bring to the table. They'll get creamed if they keep pushing the Jindals and Palins down people's throats

Maybe on your side of the world. But they need more people like them to win and bring the party back together. You may not like their policies, but the people in the states love them. I'm just hoping that this whole debacle is a wake up call to republicans. When republicans screw up, get lazy, and lose power...this is what happens. The pendulum is about to swing back, and the fat cat republicans who have the same mindset as some of these dems better check themselves. The American people and the conservative base are not going to put up with this much longer. The time is right for a REAL leader to emerge...I just don't think I've seen him yet.

You keep thinking that and you'll help the Dems stay in charge. Die hard partisans drive people away in "purple states" (a mix of consecrative and liberals) If you have someone that is ultra left or ultra right on all the issues, they will get solid numbers among their base but next to nothing from independents. With only 20% of people identifying themselves as Republicans these days, a Palin or Jindal running in a state that isn't died in the wool republican will be DOA. Keep pushing those candidates while shunning the Romneys of your party and see where that gets you. And my side of the world until Feb. 5th is the Charleston, SC side

At first, I kinda liked Jindal...until I learned that he voted to make the Patriot Act permanent. I was surprised to hear he had such a neo-conservative side!

F*CK THE BOTH OF 'EM (well, the former metaphorically, the latter literally...that hockey mom is one fine piece of ace...)

But seriously...why the f*ck does anyone consider Palin and Jindal "true conservatives"...someone needs to learn their history.

I generally keep myself out of the political discussions, but I have to agree here. I don't want either one of them representing me.
