Colonel Van T. Barfort, 90, from Richmond VA is being ordered by his homeowner association to remove the flag pole on his property.

Did you miss it? Look at the Colonel?s picture again. See what?s hanging around his neck? Yep.

The Congressional Medal of Honor.

?The decorated veteran of three wars, now 90 years old, raises the American flag every morning on the pole, then lowers and folds the flag at dusk each day in a three-corner military fashion.?

You pissed yet? If not. Leave. Immediately.

From the Richmond Times Dispatch:

In a priority mail letter, the Coates & Davenport law firm in Richmond is ordering Barfoot to remove the pole by 5 p.m. Friday or face ?legal action being brought to enforce the Covenants and Restrictions against you.? The letter states that Barfoot will be subject to paying all legal fees and costs in any successful legal proceeding pursued by the homeowner association?s board.

Barfoot lives in the Sussex Square community in far western Henrico; its board of directors rejected a plea from Barfoot in July to approve the pole, disallowing the fixture on aesthetic grounds.

"Second Lieutenant Barfoot's official Medal of Honor citation reads:

For conspicuous gallantry and intrepidity at the risk of life above and beyond the call of duty on 23 May 1944, near Carano, Italy. With his platoon heavily engaged during an assault against forces well entrenched on commanding ground, 2d Lt. Barfoot (then Tech. Sgt.) moved off alone upon the enemy left flank. He crawled to the proximity of 1 machinegun nest and made a direct hit on it with a hand grenade, killing 2 and wounding 3 Germans. He continued along the German defense line to another machinegun emplacement, and with his tommygun killed 2 and captured 3 soldiers. Members of another enemy machinegun crew then abandoned their position and gave themselves up to Sgt. Barfoot. Leaving the prisoners for his support squad to pick up, he proceeded to mop up positions in the immediate area, capturing more prisoners and bringing his total count to 17. Later that day, after he had reorganized his men and consolidated the newly captured ground, the enemy launched a fierce armored counterattack directly at his platoon positions. Securing a bazooka, Sgt. Barfoot took up an exposed position directly in front of 3 advancing Mark VI tanks. From a distance of 75 yards his first shot destroyed the track of the leading tank, effectively disabling it, while the other 2 changed direction toward the flank. As the crew of the disabled tank dismounted, Sgt. Barfoot killed 3 of them with his tommygun. He continued onward into enemy terrain and destroyed a recently abandoned German fieldpiece with a demolition charge placed in the breech. While returning to his platoon position, Sgt. Barfoot, though greatly fatigued by his Herculean efforts, assisted 2 of his seriously wounded men 1,700 yards to a position of safety. Sgt. Barfoot's extraordinary heroism, demonstration of magnificent valor, and aggressive determination in the face of pointblank fire are a perpetual inspiration to his fellow soldiers.[4]"

Cliffs:

-flanks enemy machinegun nest alone, kills 2 germans, injures 3 with grenade
-kills 2 more germans, captures 3 at another machinegun nest
-ultimately takes 17 prisoners
-later grabs bazooka and takes on 3 tanks. Disables one tank and kills crew of 3.
-advances and destroys fieldpiece with demo
-on return assists two seriously wounded men 1700 yards back to safety

Should have read the HOA Agreement. Nothing wrong with the courts holding the man to what he agreed to do. After reading about HOAs in property class last year, I would never live in one.

I would hate to find myself on the very unpopular side of this equation but while we can all certainly appreciate this hero's service one of the tenets he fought to protect was a fair and just legal system. One that allows for contractual agreements like the one he signed that spell out with no ambiguity whatsoever the obligations of any housing association member. While it certainly feels unAmerican to prevent this war hero from displaying his pride in country in such a fashion, it would be more unAmerican to throw out the rule of law as it pertains to a contract the individual in question willingly signed. With that said there is still a part of me that thinks the housing association should SUCK IT!

eff their HOA. They should build a statue of this dude. Dude is a real American Hero. and if displaying an American flag violates their rules, then they need some new fuggin rules

My parents live in a deed restricted community. Its pretty dumb, they told me I wasn't allowed to fish in the neighborhood ponds that they stock with fish. Apparently people buying homes don't like to see people using something for its intended purpose. I was given no response when I pointed out the Christmas tree someone had thrown into the pond.. or the rusted tricycle on the shallow side.

Displaying the American flag isn't against their covenants. Cementing a flagpole into his front yard is what is against the covenant. Most suburban subdivisions disallow flagpoles but you can still have the flag attached to a pole off the side of your home.
