In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.
One thing that people don't realize is that the Bill of Rights does NOT say what we can or cannot do. It limits what the GOVERNMENT can or cannot do. If you allow walls to be put up concerning certain God given freedoms, then we may wake up and find out that walls have been built up around ALL of our freedoms.
So based on your assumptions on arrest and search powers, we are going to trust the government (A government that has lied to it's people consistantly) to not abuse their powers? HA! I'll believe that when I win the lottery, have a car accident, open heart surgery and get struck by lightning in the same day.
