Yes they are fighting it, but it's rather scary that the US Government may be doing it anyways.
Under the USA Patriot Act 1 & 2 the USG can....
1. Arrest you and deny you an attorney regardless of your citizenship.
2. Search you or your property without a Federal warrant and without your knowledge.
3. Hold you indefinitely without due process. (See USA born citizen: Jose Padillia)
4. Conduct electronic/human surveillance with/without a warrant or probable cause.
5. Deport you even if you are a US citizen without due process of law.
This is a crash-course short list of things that the USA Patriot Act allows the DOJ (Dept. of Justice) to do. Scary isn't it?
BTW: The US Government was ordered by the US Supreme Court last year to charge American born Jose Padillia or release him immediately. He is still sitting in a military brig in Charleston, SC. He has been in that brig since 01 without an attorney, family visits and due process of law. The funny thing is that he's not even Islamic.
