So I'm not sure I am following you on section 2, as it pertains to common law marriages b/w a man and a woman?
every state in the Union must recognize each others legal documents. So if if 2 dudes marry in a legal state they legal in all of them

Wouldn't there need to be a constitutional amendment for it to be declared legal in Arkansas? I mean we aren't just talking about a new law.

Gay marriage stuff is a culture battle. Of course there should be legal benefits offered to homosexual people (smokey would say there already are, provided they marry someone of the opposite sex). They chose to abandon "civil unions" partly because the word "marriage" is already in the lexicon but also because they want broad social acceptance, forced if need be.
